Peru proposes Regulations for cell phones to have enabled the function of FM Radio

In order to expand the dissemination of information to the entire population during disaster and emergency situations, the Ministry of Transport and Telecommunications (MTC) of Peru has provided in Public Consultation a regulatory proposal through Ministerial Resolution No. 1328-2021-MTC/01.03, aimed at ensuring that cell phones imported and marketed in the national territory have the functionality of receiving the radio service in the FM band.

The Project aims to establish provisions so that the reception functionality of the sound broadcasting service in the Frequency Modulated (FM) band on cell phones containing the integrated reception mechanism is enabled and remains active for users.

Section 2.2 of the draft states that for the purposes of the standard, the term cell phone is subject to the definition contained in the Glossary of Terms of the Specific Regulation on the Homologation of Telecommunications Equipment and Apparatus, approved by Supreme Decree No. 001-2006-MTC, which dictates:

“TELÉFONO CELULAR: Equipo terminal móvil portable que permite como mínimo recibir y realizar llamadas telefónicas a través de la red de telefonía móvil. Esta definición comprende a los teléfonos inteligentes (smartphones) y no incluye a los relojes inteligentes u otros dispositivos que determina la Dirección General vía Resolución Directoral”.  
CELL PHONE: Portable mobile terminal equipment that allows at least to receive and make telephone calls through the mobile telephone network. This definition includes smartphones and does not include smart watches or other devices determined by the Directorate-General via a Directorate-General Resolution. (Our translation)

The MTC considers that with these provisions users will be able to access recommendations, advice and any information of interest that can be transmitted by FM sound broadcasting in emergency situations and even in cases of fall of the internet signal or mobile service networks.

In accordance with the provisions of the draft regulations, the aforementioned obligation will be enforceable to the marketing houses and applicable to face-to-face or virtual marketing, including that carried out directly by the concessionaires of mobile public services through their service centers, agencies or authorized distributors.
